1 CLUB SHOP TERMS & CONDITIONS

1.1 This page tells you the terms and conditions on which we supply products listed on our websites at brightonexcelsior.co.uk

1.2 Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you and what to do if there is a problem and other important information.

2 INFORMATION ABOUT US AND HOW TO CONTACT US

2.1 Brighton Excelsior CC is a Community Amateur Sports Club (CASC)

2.2 VC Jubilee is the name for the youth section of Brighton Excelsior CC.

2.3 You can contact the club via email or other means as outlined on our contact us page.

2.3 If we have to contact you, we will do so by telephone or by writing to you at the email address or billing address you provided to us in your order.

2.4 When we use the words “writing” or “written” in these terms, this includes emails.

3 OUR CONTRACT WITH YOU

3.1 After placing an order, you will receive an email from us to acknowledge that we have received your order. This does not mean that your order has been accepted. Our acceptance of your order will take place when you collect the goods from the club.

3.2 If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is out of stock or there is an issue with the stock we hold.

3.3 Our website is primarily intended for the promotion of our products in UK. We may accept orders from outside of these countries in special circumstances.

4 YOUR STATUS

4.1 By placing an order through our site, you warrant that:

4.1.1 you are legally capable of entering into binding contracts;

4.1.2 you are at least 16 years old;

4.1.3 You are purchasing products for private and domestic use and not for resale in the course of a business.

5 YOUR RIGHTS TO MAKE CHANGES

5.1 If you wish to make a change to the product you have ordered, please contact us by emailing orders@brightonexcelsior.co.uk. We will let you know if the change is possible.

6 PROVIDING THE PRODUCTS (Club kit)

6.1 All products must be collected in person from a member of the club either at their home address where the kit is stored or from a mutually agreed place.

6.2 No products will be dispatched by post.

6.3 The product will be your responsibility from the time the products are collected from the person handing over the goods.

6.4 We may need certain information from you so that we can supply the products to you, for example, your selected options, personal details and payment details.

7 YOUR RIGHTS TO END THE CONTRACT

7.1 Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing and when you decide to end the contract:

7.1.1 if what you have bought is faulty or misdescribed you may have a legal right to end the contract (or to get the product repaired or replaced)

7.2 For most products bought online you have a legal right to change your mind within 14 days and receive a refund. These rights, under the Consumer Contracts Regulations 2013, are explained in more detail in these terms.

7.3 You do not have a right to change your mind in respect of if products have been unsealed from the original packaging and been worn. This is due to hygiene reasons.

8 HOW TO END THE CONTRACT WITH US (INCLUDING IF YOU HAVE CHANGED YOUR MIND)

18.1 To end the contract with us, please let us know by emailing us at orders@brightonexcelsior.co.uk. Please provide your name, contact details and details of the order .

8.2 We will make any refunds due to you as soon as possible. This will usually be within 14 days of making the order.

9 OUR RIGHTS TO END THE CONTRACT

9.1 We may end the contract for a product at any time to you if:

9.1.1 you do not make any payment to us immediately or the payment method fails;

9.1.2 you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products

9.1.3 you have ordered the product believing that it will be delivered.

9.1.4 you are not or the person you are purchasing for is a current member of the club

10 IF THERE IS A PROBLEM WITH THE PRODUCT

11 OTHER IMPORTANT TERMS

11.1 The club shop is run in good faith to provide a service for its club members.

11.2 This contract is between you and us. No other person shall have any rights to enforce any of its terms.

11.3 Each of the clauses of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

11.4 These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
